PRETORIA, 16 March 2015 – On 11 September 2012 SARS obtained a judgment in terms of the Tax Administration Act 28 of 2011, in the High Court of South Africa Gauteng Division, Pretoria, confirming an outstanding tax debt by Mr JS Malema of R16.2 million.
On 10 February 2014 the Gauteng North High Court granted a provisional sequestration order against Mr Malema for this tax debt. The return date for confirmation of a final order was set for 26 May 2014.
On 26 May 2014, SARS issued a statement confirming that a compromise agreement had been reached with the taxpayer in terms of the Tax Administration Act 28 of 2011, due to which the provisional sequestration order was extended.
Today’s application by SARS in the High Court of South Africa Gauteng Division, Pretoria, was for the sequestration order to be made final. The matter is due back in court on 1 June 2015.
SARS is legally obliged to protect the taxpayer’s information. With this in mind, SARS will not make further comment on this matter.
